Terms of Sale — Blurrica

Preamble

These Terms of Sale (“Terms”) govern the subscription to Blurrica’s paid plan, a browser extension for detecting video game spoilers, published by PuzzWe, a Société par Actions Simplifiée Unipersonnelle (SASU) registered under number 107 118 499 R.C.S. Paris, with its registered address at 47 rue Vivienne, 75002 Paris, France (hereinafter “Blurrica”, “we”).

Subscribing to the plan implies full and unreserved acceptance of these Terms. For details on how we handle your personal data, see our Privacy Policy. For general usage terms, see our Terms of Use.


Article 1 — Purpose

These Terms define the conditions for subscribing, paying, renewing, and canceling the paid subscription to Blurrica (“the Subscription”), as well as the respective rights and obligations of the parties within this contractual relationship.


Article 2 — Minimum Age and Contractual Capacity

Use of Blurrica and subscription to a paid plan are reserved for individuals aged 16 or older. By creating an account and subscribing to a plan, you represent that you are at least 16 years old and have the legal capacity to enter into this contract. If you are under 16, you may not create an account or subscribe without the involvement and consent of a parent or legal guardian, who must accept these terms on your behalf.


Article 3 — Description of the Offer

Blurrica offers a single subscription granting access to all premium features of the Extension (detection and hiding of spoilers for the video games you follow). There is no limited free (“freemium”) tier: once the free trial period offered at account creation ends, access to premium features requires subscribing to the Subscription.


Article 4 — Price

The price of the Subscription is €15 (tax included) per year, unless changed in advance under the conditions set out in Article 9. The applicable price is the one in effect at the time of subscription or renewal, as displayed in the payment interface before confirmation.


Article 5 — Payment Terms

Payment is made exclusively by credit card or any other payment method offered by our payment provider, Stripe. Payment is due immediately upon subscription, and then on each renewal anniversary date (see Article 7).

Blurrica does not store any banking data; payment processing is handled entirely by Stripe, in accordance with PCI-DSS security standards. For more details, see our Privacy Policy.


Article 6 — Right of Withdrawal

6.1 Right of Withdrawal

In accordance with EU Directive 2011/83/EU and Articles L221-18 et seq. of the French Consumer Code, you have a 14-day right of withdrawal from the date of subscription, without having to justify your decision.

6.2 Immediate Start of the Service

Since access to Blurrica Premium is granted immediately upon payment confirmation, before any payment we ask you to explicitly check a box by which you:

Your request for immediate access does not prevent you from exercising your right of withdrawal during the applicable 14-day withdrawal period.

We retain proof of your request and acceptance, including the date and time of acceptance and the versions of the contractual documents presented, in accordance with our Privacy Policy.

6.3 Consequences of Withdrawal

If you exercise your right of withdrawal within 14 days of subscribing, Blurrica will refund the full amount paid for the Subscription.

No amount will be deducted for the period during which you had access to the service before exercising your right of withdrawal.

To exercise your right of withdrawal, contact us at contact@blurrica.com and clearly state that you wish to withdraw from your Subscription. You may also use the model withdrawal form provided in Article 14.

The refund will be processed without undue delay and no later than 14 days after we are informed of your decision to withdraw.

Unless you expressly agree otherwise, the refund will be made using the same payment method used for the original transaction.

6.4 After the 14-Day Period

Once the 14-day withdrawal period has expired without you exercising your right of withdrawal, the Subscription remains subject to the standard cancellation conditions set out in Article 7.

A change of mind or non-use of the service after the withdrawal period has expired does not, by itself, entitle you to a refund, without prejudice to any other rights granted to you by applicable law.


Article 7 — Renewal and Cancellation

7.1 Automatic Renewal

The Subscription is taken out for a one-year period and renews automatically for an equivalent period, unless canceled by you before the renewal date.

7.2 Cancellation

You may cancel your Subscription at any time from your account, free of charge and without justification. Cancellation takes effect at the next renewal date: it prevents automatic renewal but does not entitle you to a refund of the current period, which has already been paid for and remains accessible until its end, without prejudice to the right of withdrawal provided for in Article 6.

7.3 Pre-Renewal Notice

We will notify you by email, before each renewal date, of the possibility of not renewing your Subscription, in accordance with Article L215-1 of the French Consumer Code.


Article 8 — Refunds and Statutory Conformity Guarantee

During the 14-day withdrawal period following subscription, refunds are governed by Article 6.

After this period has expired, no refund will be issued solely on the grounds of a change of mind or non-use of the service.

This does not, however, deprive you of any other right granted by law. In particular, you continue to benefit from the statutory conformity guarantee (Articles L.217-1 et seq. of the French Consumer Code, and EU Directive 2019/770 on contracts for the supply of digital content and digital services), which applies regardless of any contractual clause and cannot be excluded by these Terms.

We commit to reviewing any good-faith claim and responding within a reasonable timeframe, in accordance with our legal obligations.


Article 9 — Changes to Price or Terms

We reserve the right to modify the Subscription price or these Terms. Any substantial change will be notified to you by email at least 30 days before it takes effect. If you do not accept the change, you may cancel your Subscription before the new price or terms take effect, without this being considered an early termination on your part.


Article 10 — Suspension and Termination by Blurrica

We may suspend or terminate your access to the Subscription in case of serious breach of these Terms or our Terms of Use (notably in case of payment fraud or fraudulent use of the service), following prior notice except in cases of urgency or technical impossibility.

In the event of a chargeback initiated by you with your bank or Stripe without going through our claims process, we reserve the right to immediately suspend your access to the service.


Article 11 — Liability

Blurrica implements reasonable measures to ensure the availability and proper functioning of the service, without guaranteeing uninterrupted availability. Our liability cannot be engaged in the event of temporary service interruption related to maintenance, a failure of our technical providers (Render, Supabase, Stripe, IGDB), or a case of force majeure.

As spoiler detection relies on automated, keyword-based text analysis, Blurrica does not guarantee exhaustive or infallible detection of all content that may constitute a spoiler, regardless of its source or wording. This limitation is inherent to the nature of the service and does not, in itself, constitute a conformity defect under Article 8, including as our detection algorithms continue to evolve.

A conformity defect, on the other hand, consists of a confirmed technical failure preventing access to the service itself, as distinct from a simple inaccuracy or an undetected spoiler.


Article 12 — Governing Law and Jurisdiction

These Terms are governed by French law, subject to the mandatory consumer protection provisions applicable in your country of habitual residence within the European Union, which you continue to benefit from in accordance with Regulation (EC) No 593/2008 (Rome I).

Any dispute relating to these Terms falls under the jurisdiction of the French courts, without prejudice to your right, as a consumer, to bring proceedings before the courts of your place of residence, in accordance with applicable EU regulations (Regulation (EU) No 1215/2012).


Article 13 — Consumer Mediation

In accordance with Articles L.616-1 et seq. of the French Consumer Code, you have the right to use a consumer mediator free of charge for the amicable resolution of any dispute with us.
